Form IT-112-R is a key document for New York State residents who have paid income taxes to another state. This form is used to claim the New York State Resident Credit, which helps avoid double taxation on income earned outside of New York. If you’re a resident of New York and you’ve worked in another state, you may have been taxed by that state on your income. The purpose of Form IT-112-R is to allow you to offset that state income tax against your New York State tax liability, ensuring you don’t pay taxes on the same income twice.

 

When to Use Form IT-112-R

You will need to file Form IT-112-R if you meet the following criteria:

  1. New York State Residency: You must be a resident of New York for tax purposes. This includes individuals who are domiciled in New York or maintain a permanent place of residence in the state.
  2. Income Earned in Another State: If you have earned income in another state that also taxes that income, you may be subject to both state taxes—the tax in the state where you earned the income and the tax in New York. Form IT-112-R allows you to claim a credit for taxes paid to the other state.
  3. Taxes Paid to Another State: To qualify for the credit, you must have actually paid income taxes to another state. This is typically documented through the state’s tax return or tax payment records. If you haven’t paid taxes to another state, there’s no need to file Form IT-112-R.

How the Credit Works

The credit is applied to your New York State tax liability, reducing the amount of tax you owe. The amount of the credit is limited to the lesser of:

  • The amount of tax you paid to the other state, or
  • The amount of New York tax you owe on the same income.

This ensures that you receive a fair credit for the taxes you’ve already paid, and it prevents you from being taxed excessively. For instance, if your New York tax on the income is higher than what you paid to another state, the credit will only cover the amount you paid to the other state, not the full New York tax liability.
